Introductory Provisions

The purpose of this document is to regulate the rules of the promotional campaign “Money-Back Guarantee” (hereinafter referred to as the “Promo” or “Promotional Campaign”). These rules govern the Promo and the refund process for Consumers in the territory of the Czech Republic.

Organizer of the Promotional Campaign

The Promo is organized by Cofado coffee, s.r.o., Company ID: 22054855, with its registered office at Korunní 2569/108, Vinohrady, 101 00 Prague 10, registered in the Commercial Register of the Municipal Court in Prague, File No. C 409556 (hereinafter referred to as the “Organizer”). Duration and Location of the Promotional Campaign

The Promo takes place from January 1, 2025, to June 30, 2025 (hereinafter referred to as the “Promo Period”).

The Promo is conducted within the territory of the Czech Republic on the e-shop www.cofado.cz (hereinafter referred to as the “Promo Website”), where specific promotional products (hereinafter referred to as “Promo Products”) are sold during the Promo Period.

Promo Products are defined as products sold by the Organizer during the Promo Period, specifically Cofado whole-bean coffee in 250 g packages.

Participants of the Promotional Campaign

Participation in the Promo is open only to individuals who cumulatively meet the following conditions:

1. Eligibility:

A natural person (Consumer) aged 18 or older.

Permanent residence and delivery address in the Czech Republic.

A current bank account in CZK held in their name with a bank authorized to provide banking services in the Czech Republic.

2. Exclusions:

Individuals who return the purchased goods (Promo Products), except for defective items replaced with non-defective ones, are excluded from participation.

Participants who fail to meet the conditions or act contrary to the rules will not be included in the Promo.

Even if a person appears to meet certain conditions for a refund, for example, by providing false information, they are not entitled to a refund. Participants will also be excluded if the Organizer discovers or has reasonable suspicion of fraudulent or unfair conduct by a Consumer or another person assisting the Consumer in obtaining a refund.

Mechanics of the Promotional Campaign

The Promo applies to Consumers who, after tasting the Promo Product, find it unsatisfactory. The purpose of the Promo is to offer refunds to those Consumers who are not satisfied with their purchase.

To participate in the Promo, a Consumer must follow these steps:

1. Purchase and Receipt:

During the Promo Period, purchase one Promo Product and retain a valid receipt proving the purchase (hereinafter referred to as the “Receipt”).

2. Refund Form:

Print the refund form available on the Promo Website (hereinafter referred to as the “Form”) and fill in the following details:

Name and Surname

Email

Phone Number

Bank Account Number

Price of the purchased product (excluding postage and after discounts)

Receipt/Document number

Date and time from the Receipt

A comment of at least 15 words explaining dissatisfaction with the Promo Product.

3. Submission:

Sign the completed Form, scan or photograph it clearly, and send it along with a photo of the Receipt and the Promo Product (clearly showing that the product was used) to info@cofado.com.

4. Limitations:

Each Consumer may participate in the Promo only once during the Promo Period. Participation is allowed using only one unique email address, phone number, and bank account. Submissions using duplicate contact or bank details will be excluded.

5. Deadline:

Submissions must be made no later than 15 days after the end of the Promo, i.e., by July 15, 2025.

Evaluation of the Promo and Refund Process

1. Eligibility:

Each Consumer can participate in the Promo only once during the Promo Period.

2. Organizer’s Discretion:

The Organizer will determine eligibility for a refund based solely on its discretion.

3. Evaluation Criteria:

The Form must be completed in full and submitted by July 15, 2025.

Personal details must appear valid.

The comment must contain a minimum of 15 words providing a valid reason for dissatisfaction. Comments containing vulgarities, inappropriate expressions, threats, or violations of good manners, promoting other products or services, or any unlawful content will be deemed invalid.

4. Refund Details:

Only one refund per Consumer is allowed during the Promo.

If multiple Promo Products are purchased in one transaction, a refund will only be issued for one Promo Product.

5. Notification:

Eligible participants will be informed via email.

6. Verification:

The Organizer reserves the right to request additional verification, such as proof of purchase, at any time. Failure to comply will result in disqualification.

7. Processing Time:

Refunds will be issued within 30 days of submitting the completed Form.

Processing of Personal Data

Each Consumer, as the data subject, has the following rights:

Right of access and information: Consumers can obtain information from the Organizer on whether their Personal Data is being processed, for what purpose, the scope of data being processed, and to whom the data has been disclosed.

Right to correction: Consumers can request the correction of inaccurate or incorrect data or the completion of incomplete Personal Data.

Right to erasure: Consumers can request the deletion of their Personal Data if it is no longer necessary for the purposes for which it was collected or processed, if the Consumer withdraws their consent and there are no other legal grounds for processing, if the data is being processed unlawfully, or if deletion is required to comply with the Organizer’s legal obligations.

Right to restriction of processing: Consumers can request that processing be restricted if they dispute the accuracy of the data (for a period allowing the Organizer to verify its accuracy), if processing is unlawful and they oppose erasure, or if the data is no longer needed by the Organizer but is required by the Consumer for legal claims.

Right to data portability: Consumers can request their Personal Data in a structured and machine-readable format, either for themselves or another data controller.

Right to object: Consumers can object to the processing of Personal Data based on the legitimate interest of the Organizer or other Consumers in connection with the Promo.

Right to file a complaint: If Consumers suspect a breach of data protection regulations, they can file a complaint with the supervisory authority – the Office for Personal Data Protection, at Pplk. Sochora 27, 170 00 Prague 7, www.uoou.cz.

If Personal Data processing is a necessary condition for participating in the Promo and the Organizer is requested to transfer or delete the provided Personal Data, this will result in the termination of the Consumer’s participation in the Promo, including the loss of entitlement to a refund.

Cookies and Website Information

The Organizer informs Consumers that the Promo Website may use cookies solely for facilitating its technical operation. Management or disabling cookies can be performed using tools available in standard web browsers.

Evaluation of the Promo and Refund Process

A Consumer may participate in the Promo only once during the Promo Period.

The evaluation of whether the Consumer is entitled to a refund will be solely at the discretion of the Organizer.

When evaluating, the Organizer will take into account, among other things, the following:

The Consumer completed all fields in the Form and submitted the fully completed Form to the Organizer no later than July 15, 2025.

The Consumer’s personal data appears to be valid.

The Form includes all valid information as specified in Article 5 of these rules.

The comment must contain a minimum of 15 words providing a valid reason for the Consumer’s dissatisfaction with the Promo Product. If the comment contains vulgarities, inappropriate or obscene language, threats or intimidating expressions, violates good manners, promotes products, services, or businesses of other entities, constitutes or incites a criminal offense, violates legal regulations, or fails to comply with the requirements (i.e., is unrelated to negative feedback about the Promo Product), the Consumer will not be entitled to a refund. The validation of the comment, including whether it meets the conditions of these rules, is exclusively at the discretion of the Organizer.

A Consumer who has been granted entitlement to a refund will be reimbursed the amount stated on the Receipt.

During the Promo Period, a Consumer is entitled to a refund only once. Additionally, if the Consumer purchases multiple units of the same type of Promo Product (e.g., multiple packages) in a single purchase (on one Receipt), they are entitled to a refund for only one Promo Product, regardless of the number of packages purchased. If the Consumer purchases one or more packages of Promo Products weighing 250 g and simultaneously one or more packages weighing more than 250 g in a single purchase, they are entitled to a refund for only one 250 g package of the Promo Product.

If a refund claim is approved, the Consumer will be notified via the email address provided in the Form.

The Organizer reserves the right, before transferring the funds and at any time during or after the Promo, to request the Consumer to verify the accuracy of the information provided during registration for the Promo, to provide Receipts, or to otherwise prove compliance with these rules. If the Consumer fails to respond to such a request or fails to provide the requested documents, the Consumer forfeits the right to a refund, and the funds will not be transferred.

Refunds will be processed within 30 days after the submission of the completed Form.

General Provisions

By participating in the Promo, each participant expresses their agreement with its rules and undertakes to comply with these rules unconditionally.

The Organizer of the Promo reserves the right to modify the rules of the Promo or to change or cancel the Promo at any time without providing a reason.

Any depiction of the refund in promotional materials is for illustrative purposes only.

The Organizer does not provide technical support or advisory services (including tax and legal advice) in connection with the Promo. The Organizer is not responsible for the inability to participate in the Promo due to technical or other reasons.

The Organizer of the Promo is entitled to verify all conditions for participation in the Promo and, in the event of a dispute, to assess and make a final decision on any issue related to the Promo at its sole discretion. The Organizer has the right to exclude any Consumer from the Promo if such a Consumer violates the rules, acts contrary to good morals in connection with the Promo, attempts to obtain a refund fraudulently, damages the reputation of the Organizer or other Consumers, or is reasonably suspected of such activities. This exclusion is without compensation for costs or damages incurred by the Consumer as a result of the exclusion.

The Organizer informs Consumers that consumer competitions fall under the Consumer Protection Act. The authority supervising compliance with the Consumer Protection Act is the Czech Trade Inspection Authority, www.coi.cz.

By participating in the Promo, or by registering for the Promo, the Consumer expresses their agreement with the rules and terms of the Promo.

Information about the Promo is provided on the Promo Website at the following URL: www.cofado.cz/garance-vraceni-penez.

The rules may be communicated in a shortened version in promotional materials related to the Promo, but the only valid rules in their entirety are published electronically on the Promo Website during the Promo Period, specifically at the URL: www.cofado.cz/garance-vraceni-penez. In the event of a conflict between the provisions of these rules and promotional materials related to the Promo, or in the event of ambiguities regarding the interpretation of the rules or promotional materials, the provisions of these rules shall take precedence.
